The volume is a comprehensive evaluation of epistemic, practical, veridical issues from the perspective of every kind of failure, disruption, or confusion that comes under the general rubric of “error.” The analysis is not limited to the element of negativity, but rather, an inquiry about the extent that error can be transformed into a starting point or precondition for successful epistemic practices.

This article traces a Muslim tradition of natural law in the thought of Ibn Rushd. I argue that this notion of natural law enriches the concept of law and can mediate conflicts of human law and divine law in Islam. I discuss the ontology, then epistemology, of Ibn Rushd’s natural law, then situate the resultant conception of law within Islamic legal and theological contexts.

The Decisive Treatise: The Connection Between Islamic Religious Law and Philosophy, 2017

The Decisive Treatise is perhaps the most controversial work of Averroes (Ibn Rushd, 1126-1198) and belongs to a trilogy which boldly represent the philosophical contribution to Islamic theology of this famous Andalusian commentator on Aristotle. The Decisive Treatise is a fatwa (a legal opinion) that the judge, Averroes, promulgated for his fellow Malikite jurists in order to demonstrate that the study of philosophy is not only licit from the point of view of religious law, but even mandatory for the skilled people. However, many subjects are dealt with in this comparatively short book: An epistemology aimed to show that philosophical truth and religious truth are not in contradiction; a sociology of knowledge pointing out that humans are classified in three classes (philosophers, theologians, common folk); a Qur’anic hermeneutics suggesting how to approach philosophically the Holy Book in agreement with religious requirements and linguistic rules.

Responding to the accusations of the Ašʿarite theologian al-Ġazālī, in his Decisive Treatise Averroes champions the practice of philosophy, using legal and scriptural arguments. In this article, I wish to place these arguments within the context of legal theory, a discipline to which Averroes devoted one of his earliest treatises, the Abridgment of al-Mustaṣfā . A comparison of these two texts allows us to identify the origin of some arguments of the Decisive Treatise, concerning the taxonomy of errors and the social organization of knowledge. My aim is to set Averroes’ reflection within a continuity of the Islamic meta-legal tradition that provided him with the necessary tools for his conceptualization of the philosopher’s place within society.

In his Decisive Treatise, Andalusian philosopher Averroes (1126–1198) analyzes the relation between philosophy and religion from an Islamic legal perspective. He emphasizes the obligation upon some Muslims to study philosophy and how philosophy can be considered one of the Islamic sciences. He mentions the significance of a nonliteral reading of the Qur’ān and defends the compatibility between Aristotelian philosophy and Islamic religion.

Both the received canon of Islamic philosophers and the grand narrative of the course of Islamic philosophy are in the process of being radically questioned and revised. The bulk of twentieth-century Western scholarship on Arabic or Islamic philosophy focused on the period from the ninth century to the twelfth. It is a measure of the transformation that is currently underway in the field that the present Handbook gives roughly equal weight to every century from the ninth to the twentieth. The Handbook differs from previous overviews in another significant way: It is work-centered rather than person- or theme-centered. This format is intended to give readers a better sense of what a work in Islamic philosophy looks like, and of the issues, concepts, and arguments that are at play in works belonging to various periods and subfields within Islamic philosophy.","republication_of":0,"online_url":"","online_resources":null,"translation_of":"0","new_edition_of":"0","is_catalog":0,"in_bibliography":0,"is_inactive":0,"notes":null,"ti_url":"","doi_url":"10.1093\/oxfordhb\/9780199917389.001.0001","book":{"id":5212,"pubplace":"New York, NY","publisher":"Oxford University Press","series":"Oxford handbooks ","volume":"","edition_no":"","valid_from":null,"valid_until":null}}},"article":null},"sort":[2016]}

The Oxford Handbook of Islamic Philosophy, 2016

The study of Islamic philosophy has recently entered a new and exciting phase. Both the received canon of Islamic philosophers and the grand narrative of the course of Islamic philosophy are in the process of being radically questioned and revised. The bulk of twentieth-century Western scholarship on Arabic or Islamic philosophy focused on the period from the ninth century to the twelfth. It is a measure of the transformation that is currently underway in the field that the present Handbook gives roughly equal weight to every century from the ninth to the twentieth. The Handbook differs from previous overviews in another significant way: It is work-centered rather than person- or theme-centered. This format is intended to give readers a better sense of what a work in Islamic philosophy looks like, and of the issues, concepts, and arguments that are at play in works belonging to various periods and subfields within Islamic philosophy.

One of Averroes' (Ibn Rushd) earliest works is dedicated to law. The work comprises a summary of al-Ghazali's work on legal theory called al-Mustasfa min 'ilm al-usul. This volume presents a new edition of the Arabic text accompanied by a French translation and commentary. The edition is preceded by a study that draws attention to the main points of difference between the two philosophers.

Gersonides’ Afterlife is the first full-scale treatment of the reception of one of the greatest scientific minds of medieval Judaism: Gersonides (1288–1344). An outstanding representative of the Hebrew Jewish culture that then flourished in southern France, Gersonides wrote on mathematics, logic, astronomy, astrology, physical science, metaphysics and theology, and commented on almost the entire bible. His strong-minded attempt to integrate these different areas of study into a unitary system of thought was deeply rooted in the Aristotelian tradition and yet innovative in many respects, and thus elicited diverse and often impassionate reactions. For the first time, the twenty-one papers collected here describe Gersonides’ impact in all fields of his activity and the reactions from his contemporaries up to present-day religious Zionism.
