Gersonides’ Afterlife is the first full-scale treatment of the reception of one of the greatest scientific minds of medieval Judaism: Gersonides (1288–1344). An outstanding representative of the Hebrew Jewish culture that then flourished in southern France, Gersonides wrote on mathematics, logic, astronomy, astrology, physical science, metaphysics and theology, and commented on almost the entire bible. His strong-minded attempt to integrate these different areas of study into a unitary system of thought was deeply rooted in the Aristotelian tradition and yet innovative in many respects, and thus elicited diverse and often impassionate reactions. For the first time, the twenty-one papers collected here describe Gersonides’ impact in all fields of his activity and the reactions from his contemporaries up to present-day religious Zionism.

Starting with a review of al-Ghazālī’s role in the emergence of post-Avicennan philosophical theology, the book offers a series of case studies on hitherto unstudied texts by the towering thinker Fakhr al-Dīn al-Rāzī as well as specific philosophical and theological topics treated in his works. Studies furthermore shed light on the transmission and reception of later Ashʿarī doctrines in periods and regions that have so far received little scholarly attention. This book is the first exploration of the later Ashʿarī tradition across the medieval and early-modern period through a trans-regional perspective.

Contributors: Peter Adamson, Asad Q. According to the Sunnī legal tradition, legal norms should be derived from the authoritative texts of the Qurʾān and Sunna. However, how exactly to derive such norms remains unclear, when no reference can be found to the matter at hand within these sources. The use of maqāṣid at this point might be a viable solution. Little attention, however, is paid to alternative approaches like the one of Ibn Rushd al-Ḥafīd (d 595/1198), which is based on philosophical ethics. Ibn Rushd derives ‘legal precepts’ through analysing the most prominent legal verdicts of Islamic law that were passed by various madhhab. These precepts not only enabled scholars to resolve new legal problems by using ijtihād, they also shed new light on existing legal challenges. This article will analyse Ibn Rushd’s legal hermeneutics in his Bidāyat al-mujtahid by looking at the passages concerning sales of ritually pure (ṭāhir) goods and interest (ribā).

Religious freedom is one of the most debated and controversial human rights in contemporary public discourse. At once a universally held human right and a flash point in the political sphere, religious freedom has resisted scholarly efforts to define its parameters. Taliaferro explores a different way of examining the tensions between the aims of religion and the needs of political communities, arguing that religious freedom is a uniquely difficult human right to uphold because it rests on two competing conceptions, human and divine. Drawing on classical natural law, Taliaferro expounds a new, practical theory of religious freedom for the modern world. By examining conceptions of law such as Sophocles' Antigone, Maimonides' Guide of the Perplexed, Ibn Rushd's Middle Commentary on Aristotle's Rhetoric, and Tertullian's writings, The Possibility of Religious Freedom explains how expanding our notion of law to incorporate such theories can mediate conflicts of human and divine law and provide a solid foundation for religious liberty in modernity's pluralism.

Chapter Four builds an Islamic theory of natural law from Ibn Rushd’s (Averroes’) Middle Commentary on Aristotle’s Rhetoric (Talkhi? Kitab al-Kha?aba li Aris?u). This chapter provides original exegesis on Ibn Rushd’s text, particularly those passages concerning what Ibn Rushd describes as an unwritten law of nature (sunan ghayr maktuba fi ?abi?at al-jami?). It expounds upon what I argue is a theory of natural law in the commentary that is largely consonant with Aristotelian natural justice as well as thoroughly Islamic in such a way that it can, and even ought to, inform contemporary understandings of shari?a. This chapter contains the most in-depth discussion of the relationship between revealed religion and natural law, as well as the most detailed proposal for a natural law epistemology.

[2019]}

This article is an analysis of the political thought of Ibn Rushd and its significance for the current conflict in Islamic political thought between liberal, secular and conservative Islamist thinkers over the meaning of the “virtuous society” and how it can be implemented. It is argued that the thought of Ibn Rushd offers a concept of the virtuous society that reconciles secular law and religious Sharī‘a law. The article analyzes Ibn Rushd’s Commentary on Plato’s Republic, and assesses it as potentially being able to reconcile the philosophical conflict between logically discerned law and revealed law. It is contended that the separation between “religious” and “political” (i.e., philosophical) domains often attributed to Ibn Rushd does not fully consider the entirety of Ibn Rushd’s writings and interprets his works without regard for their historical and religious contextual significance.

An investigation of Averroes' theory of reasoning in law, showing that his legal epistemology is deeply indebted to the Aristotelian tradition and, in particular, to al-Fārābī’s understanding of analogical reasoning which was in turn based on the idea of an exemplum (mithāl), taken from Aristotle’s logical works and especially the Rhetoric.

In his Decisive Treatise, Andalusian philosopher Averroes (1126–1198) analyzes the relation between philosophy and religion from an Islamic legal perspective. He emphasizes the obligation upon some Muslims to study philosophy and how philosophy can be considered one of the Islamic sciences. He mentions the significance of a nonliteral reading of the Qur’ān and defends the compatibility between Aristotelian philosophy and Islamic religion.

It is a measure of the transformation that is currently underway in the field that the present Handbook gives roughly equal weight to every century from the ninth to the twentieth. In this chapter, I will focus on Averroes's position on family and property in his Commentary on Plato's “Republic.” I will lay out his views on the role of parents in the education of children, and the place of women and children within the family and in society. I will examine Averroes's stance on private and collective property, as well as his questions pertaining to the transmission of property. Averroes's primary goal in this commentary is arguably to elucidate Plato's analysis of the structure of the ideal political state, given that, by his own admission, he could not find an Arabic translation of Aristotle's Politics. A distinction can in principle be made between Plato's views as expounded by Averroes, and the latter's own views on a given subject. Averroes’ positions can be discerned in the way he introduces personal comments and references to contemporary al-Andalus. In order to discern Averroes's positions and to discover whether he concurs with Plato on issues such as the question of education and the status of women and property, comparisons will be drawn with his main legal work, Bidāyat al-Mujtahid wa-Nihāyat al-Muqtaṣid, so as to uncover his position on such legal matters as family law and property law. It seems that Averroes would have preferred to write a commentary on Aristotle's Politics, since Aristotle's views are closer to his own. In spite of the fact that he is writing on a philosopher with whom he has fewer affinities, he succeeds in presenting many of his own views in this commentary on Plato. This is perhaps owing to the fact that Averroes often quotes Alfarabi, who greatly admired Plato's philosophy and held it to be in harmony with Aristotle’s. Thus Alfarabi, who is a great source of inspiration for Averroes, constitutes in this instance a strong link between Averroes and Plato. Averroes draws on Plato and appears to agree with him in many respects. Writing on Plato's work also allows him to expound some of his own views on issues such as virtue, education, the political state, and religion. In the Commentary on Plato's “Republic” there are echoes of works by Alfarabi, in particular The Attainment of Happiness.

Averroes’ Corrective Philosophy of Law, 2019

A study of “philosophy of law” in Averroes, showing that he assimilates the methods and epistemic status of juridical reasoning to those of rhetoric, so that legal proofs are akin to cases of rhetorical persuasion. Since legal conviction is thus always merely probable, Averroes is able to develop a notion of law as evolving and needing constant correction, as befits a system of norms that applies to changing human circumstance.
