Responding to the accusations of the Ašʿarite theologian al-Ġazālī, in his Decisive Treatise Averroes champions the practice of philosophy, using legal and scriptural arguments. In this article, I wish to place these arguments within the context of legal theory, a discipline to which Averroes devoted one of his earliest treatises, the Abridgment of al-Mustaṣfā . A comparison of these two texts allows us to identify the origin of some arguments of the Decisive Treatise, concerning the taxonomy of errors and the social organization of knowledge. My aim is to set Averroes’ reflection within a continuity of the Islamic meta-legal tradition that provided him with the necessary tools for his conceptualization of the philosopher’s place within society.

In his Decisive Treatise, Andalusian philosopher Averroes (1126–1198) analyzes the relation between philosophy and religion from an Islamic legal perspective. He emphasizes the obligation upon some Muslims to study philosophy and how philosophy can be considered one of the Islamic sciences. He mentions the significance of a nonliteral reading of the Qur’ān and defends the compatibility between Aristotelian philosophy and Islamic religion.

On the Idea of Potency: Juridical and Theological Roots of the Western Cultural Tradition, 2016

A critique of the metaphysical concept of power and potency in the history of Western jurisprudence Sweeping through the history of Western philosophy of law, Emanuele Castrucci deals with the metaphysical idea of potency as defined by Spinoza and Nietzsche, upsetting entrenched theories of jurisprudence. Castrucci first addresses how the idea of potency can change the meaning of the power ascribed to an omnipotent God. This brings together classical Greek philosophy with Jewish biblical exegesis, which Castrucci links through the juncture of Christianity. He then relates potency to the classical philosophical tradition in Aristotle's Metaphysics and its Arabic interpretations, particularly Ibn Rushd's (Averroës). This leads us to the genesis of natural law theory in Western philosophy, from Augustine to Aquinas and from Duns Scotus to Ockham. Moving on, Castrucci examines the inherently problematic concept of political theology, pitting Spinozan–Nietzschean potency against Kant and Enlightenment natural law to reveal the weaknesses inherent in the Enlightenment system. Finally, Castrucci applies the theories of Carl Schmitt to the philosophical rationalism of the Western tradition, showing us how it has failed to contain absolute power in a juridical sense.

Gersonides’ Afterlife is the first full-scale treatment of the reception of one of the greatest scientific minds of medieval Judaism: Gersonides (1288–1344). An outstanding representative of the Hebrew Jewish culture that then flourished in southern France, Gersonides wrote on mathematics, logic, astronomy, astrology, physical science, metaphysics and theology, and commented on almost the entire bible. His strong-minded attempt to integrate these different areas of study into a unitary system of thought was deeply rooted in the Aristotelian tradition and yet innovative in many respects, and thus elicited diverse and often impassionate reactions. For the first time, the twenty-one papers collected here describe Gersonides’ impact in all fields of his activity and the reactions from his contemporaries up to present-day religious Zionism.

This article traces a Muslim tradition of natural law in the thought of Ibn Rushd. I argue that this notion of natural law enriches the concept of law and can mediate conflicts of human law and divine law in Islam. I discuss the ontology, then epistemology, of Ibn Rushd’s natural law, then situate the resultant conception of law within Islamic legal and theological contexts.

This article was presented at the conference “Philosophical Perspectives on Scriptural Exegesis in Judaism, Christianity and Islam” held at Universidad Panamericana, Mexico City, April 5 and 6, 2018, organized by Luis Xavier López-Farjeat. I would like to thank him warmly for his generous invitation, Louise Agasse for her corrections of my English text, and Richard Taylor for his comments and suggestions. Finally, I thank Yahya Michot for agreeing to publish this text in The Muslim world. Unless otherweise noted, all translations from Arabic are my own.

According to the Sunnī legal tradition, legal norms should be derived from the authoritative texts of the Qurʾān and Sunna. However, how exactly to derive such norms remains unclear, when no reference can be found to the matter at hand within these sources. The use of maqāṣid at this point might be a viable solution. Little attention, however, is paid to alternative approaches like the one of Ibn Rushd al-Ḥafīd (d 595/1198), which is based on philosophical ethics. Ibn Rushd derives ‘legal precepts’ through analysing the most prominent legal verdicts of Islamic law that were passed by various madhhab. These precepts not only enabled scholars to resolve new legal problems by using ijtihād, they also shed new light on existing legal challenges. This article will analyse Ibn Rushd’s legal hermeneutics in his Bidāyat al-mujtahid by looking at the passages concerning sales of ritually pure (ṭāhir) goods and interest (ribā).
