| This study portrays the unique philosophical approach of Ibn Rušd to systematising Islamic law flexibly in order to solve the problems Muslims experience in daily life. His approach allows for a new perspective in the discourse on how to update Islamic law for contemporary times and how norms are qualified as being Islamic. Taking the prohibition of usury as an example, this study scrutinises Ibn Rušd’s approach and compares it with others from Muslim legal scholarship. For this purpose, the introduction and the chapter on usury in his juristic work Bidāyat al-mujtahid have been translated and commented on, with his approach analysed and the sources that he consulted identified. |

| Religious freedom is one of the most debated and controversial human rights in contemporary public discourse. At once a universally held human right and a flash point in the political sphere, religious freedom has resisted scholarly efforts to define its parameters. Taliaferro explores a different way of examining the tensions between the aims of religion and the needs of political communities, arguing that religious freedom is a uniquely difficult human right to uphold because it rests on two competing conceptions, human and divine. Drawing on classical natural law, Taliaferro expounds a new, practical theory of religious freedom for the modern world. By examining conceptions of law such as Sophocles' Antigone, Maimonides' Guide of the Perplexed, Ibn Rushd's Middle Commentary on Aristotle's Rhetoric, and Tertullian's writings, The Possibility of Religious Freedom explains how expanding our notion of law to incorporate such theories can mediate conflicts of human and divine law and provide a solid foundation for religious liberty in modernity's pluralism. |

| One of Averroes' (Ibn Rushd) earliest works is dedicated to law. The work comprises a summary of al-Ghazali's work on legal theory called al-Mustasfa min 'ilm al-usul. This volume presents a new edition of the Arabic text accompanied by a French translation and commentary. The edition is preceded by a study that draws attention to the main points of difference between the two philosophers. L'un des premiers traités d'Averroès est consacré au droit. Il s'agit d'un abrégé de la somme de théorie juridique d'al-Ghazāli, al-Mustasfā min 'ilm al-usūl. Cette nouvelle édition du texte est accompagnée d'une traduction française et d'un commentaire qui replace les arguments dans leur tradition doctrinale, celle de la théorie juridique véhiculée par le Mustasfā, l'un des traités les plus marquants de cette discipline. |

| The Decisive Treatise is perhaps the most controversial work of Averroes (Ibn Rushd, 1126-1198) and belongs to a trilogy which boldly represent the philosophical contribution to Islamic theology of this famous Andalusian commentator on Aristotle. The Decisive Treatise is a fatwa (a legal opinion) that the judge, Averroes, promulgated for his fellow Malikite jurists in order to demonstrate that the study of philosophy is not only licit from the point of view of religious law, but even mandatory for the skilled people. However, many subjects are dealt with in this comparatively short book: An epistemology aimed to show that philosophical truth and religious truth are not in contradiction; a sociology of knowledge pointing out that humans are classified in three classes (philosophers, theologians, common folk); a Qur’anic hermeneutics suggesting how to approach philosophically the Holy Book in agreement with religious requirements and linguistic rules. |

| A critique of the metaphysical concept of power and potency in the history of Western jurisprudence Sweeping through the history of Western philosophy of law, Emanuele Castrucci deals with the metaphysical idea of potency as defined by Spinoza and Nietzsche, upsetting entrenched theories of jurisprudence. Castrucci first addresses how the idea of potency can change the meaning of the power ascribed to an omnipotent God. This brings together classical Greek philosophy with Jewish biblical exegesis, which Castrucci links through the juncture of Christianity. He then relates potency to the classical philosophical tradition in Aristotle's Metaphysics and its Arabic interpretations, particularly Ibn Rushd's (Averroës). This leads us to the genesis of natural law theory in Western philosophy, from Augustine to Aquinas and from Duns Scotus to Ockham. Moving on, Castrucci examines the inherently problematic concept of political theology, pitting Spinozan–Nietzschean potency against Kant and Enlightenment natural law to reveal the weaknesses inherent in the Enlightenment system. Finally, Castrucci applies the theories of Carl Schmitt to the philosophical rationalism of the Western tradition, showing us how it has failed to contain absolute power in a juridical sense. |
