| A critique of the metaphysical concept of power and potency in the history of Western jurisprudence Sweeping through the history of Western philosophy of law, Emanuele Castrucci deals with the metaphysical idea of potency as defined by Spinoza and Nietzsche, upsetting entrenched theories of jurisprudence. Castrucci first addresses how the idea of potency can change the meaning of the power ascribed to an omnipotent God. This brings together classical Greek philosophy with Jewish biblical exegesis, which Castrucci links through the juncture of Christianity. He then relates potency to the classical philosophical tradition in Aristotle's Metaphysics and its Arabic interpretations, particularly Ibn Rushd's (Averroës). This leads us to the genesis of natural law theory in Western philosophy, from Augustine to Aquinas and from Duns Scotus to Ockham. Moving on, Castrucci examines the inherently problematic concept of political theology, pitting Spinozan–Nietzschean potency against Kant and Enlightenment natural law to reveal the weaknesses inherent in the Enlightenment system. | Averroës (Ibn Rushd, 1126-1198) emerged from an eminent family in Muslim Spain to become the first and last great Aristotelian of the classical Islamic world; his meticulous commentaries influenced Christian thinkers and earned him favorable mention (and a relatively pleasant fate) in Dante’s Divina Commedia. The Book of the Decisive Treatise was and remains one his most important works and one of history’s best defenses of the legitimate role of reason in a community of faith. The text presents itself as a plea before a tribunal in which the divinely revealed Law of Islam is the sole authority; Averroës, critical of the anti-philosophical tone of the Islamic establishment, argues that the Law not only permits but also mandates the study of philosophy and syllogistic or logical reasoning, defending earlier Muslim philosophers and dismissing criticisms of them as more harmful to the Islamic community than the philosophers’ own views had been. As he details the three fundamental methods the Law uses to aid people of varied capacities and temperaments, Averroës reveals a carefully formed and remarkably argued conception of the boundaries and uses of faith and reason. |

| A critique of the metaphysical concept of power and potency in the history of Western jurisprudence Sweeping through the history of Western philosophy of law, Emanuele Castrucci deals with the metaphysical idea of potency as defined by Spinoza and Nietzsche, upsetting entrenched theories of jurisprudence. Castrucci first addresses how the idea of potency can change the meaning of the power ascribed to an omnipotent God. This brings together classical Greek philosophy with Jewish biblical exegesis, which Castrucci links through the juncture of Christianity. He then relates potency to the classical philosophical tradition in Aristotle's Metaphysics and its Arabic interpretations, particularly Ibn Rushd's (Averroës). This leads us to the genesis of natural law theory in Western philosophy, from Augustine to Aquinas and from Duns Scotus to Ockham. Moving on, Castrucci examines the inherently problematic concept of political theology, pitting Spinozan–Nietzschean potency against Kant and Enlightenment natural law to reveal the weaknesses inherent in the Enlightenment system. Finally, Castrucci applies the theories of Carl Schmitt to the philosophical rationalism of the Western tradition, showing us how it has failed to contain absolute power in a juridical sense. |

The Decisive Treatise is a fatwa (a legal opinion) that the judge, Averroes, promulgated for his fellow Malikite jurists in order to demonstrate that the study of philosophy is not only licit from the point of view of religious law, but even mandatory for the skilled people. However, many subjects are dealt with in this comparatively short book: An epistemology aimed to show that philosophical truth and religious truth are not in contradiction; a sociology of knowledge pointing out that humans are classified in three classes (philosophers, theologians, common folk); a Qur’anic hermeneutics suggesting how to approach philosophically the Holy Book in agreement with religious requirements and linguistic rules. |

| Religious freedom is one of the most debated and controversial human rights in contemporary public discourse. At once a universally held human right and a flash point in the political sphere, religious freedom has resisted scholarly efforts to define its parameters. Taliaferro explores a different way of examining the tensions between the aims of religion and the needs of political communities, arguing that religious freedom is a uniquely difficult human right to uphold because it rests on two competing conceptions, human and divine. Drawing on classical natural law, Taliaferro expounds a new, practical theory of religious freedom for the modern world. | Ibn Rushd's "Bidayat al-Mujtahid" ("The Distinguished Jurist's Primer") occupies a unique place among the authoritative manuals of Islamic law. It is designed to prepare the jurist for the task of the mujtahid, the independent jurist, who derives the law and lays down precedents to be followed by the judge in the administration of justice. In this manual Ibn Rushd traces most of the issues of Islamic law, describing not only what the law is, but also elaborating the methodology of some of the greatest legal minds in Islam to show how such laws were derived. This text provides a still-relevant basis for the interpretation and formulation of Islamic law. | This study portrays the unique philosophical approach of Ibn Rušd to systematising Islamic law flexibly in order to solve the problems Muslims experience in daily life. His approach allows for a new perspective in the discourse on how to update Islamic law for contemporary times and how norms are qualified as being Islamic. Taking the prohibition of usury as an example, this study scrutinises Ibn Rušd’s approach and compares it with others from Muslim legal scholarship. For this purpose, the introduction and the chapter on usury in his juristic work Bidāyat al-mujtahid have been translated and commented on, with his approach analysed and the sources that he consulted identified. |
