Rhetoric in the Court: Averroes on Testimonial Witnessing and Oaths, 2018

Looking at the reception of Aristotle’s Rhetoric in the Arabic tradition, particularly Averroes’ Middle commentary on Aristotle’s Rhetoric (Talḫīṣ al-ḫaṭāba), I discern the impact of the Islamic legal context on the commentator’s reading of Aristotle’s theory of rhetoric. Placing Averroes’ interpretive enterprise within the context of Islamic governance has already been highlighted, particularly the role of Islamic law in his conception of the political role of rhetoric. Such attention to Islamic law, however, has often been conceived in a theoretical fashion, without attesting to the concrete and epistemological basis of legal practices of the courts. Focusing on Averroes’ discussion of the role of rhetoric in the judicial discourse, I address the impact of Islamic legal procedures known as the rules of evidence: witnesses and oaths and their modus operandi in the court, in shaping Averroes’ conception of the political role of rhetoric. Accounting for Islamic rules of evidence, I argue that Averroes ascribes a practical role to rhetoric in the court in order to establish a consensus in the implementation of justice. In so doing, Averroes oversteps his role as commentator and rather draws from his own practical concerns over the implementation of justice in the court as a legal practitioner: the Qāḍī of Cordova.

Perceived in different historical periods and in different cultural forms either as a conflict or as a vital coexistence, the reason/no-reason pair was first theorized and legitimated as a sharp contrast in antiquity with the Pythagorean systoichiai, and at the dawn of the twentieth century it was successfully exemplified by Nietzsche through the opposition between Apollonian and Dionysian principles, which denotes respectively the harmonious, orderly, 'bright' side of the human soul, and the chaotic one, wild, instinctive, passionate, 'dark'. This volume is the outcome of the work of an international research group, which intended to cover some aspects of this dichotomy with the specific end to prove that the two sides of the human 'soul' don't contradict each other - in such a way that one excludes, ontologically and axiologically, the other - but they are rather closely interrelated and interdependent. Scholars with different expertise in the history of thought tackled diachronically some key moments of this story, from different angles and with different approaches, from ancient thought to modern neurosciences. The volume contains contributions of Krzysztof Brzechczyn (Institute of Philosophy, Adam Mickiewicz University), R. Loredana Cardullo (University of Catania), Francesco Coniglione (University of Catania), Santo Di Nuovo (University of Catania), Daniele Iozzia (University of Catania), Syliane Malinowski-Charles (Université du Québec à Trois Rivière), Concetto Martello (University of Catania), Alexandra Michalewski (Paris - Sorbonne, CNRS), Chiara Militello (University of Catania), Sebastian Moro Tornese (United Kingdom), Jean-Marc Narbonne (Laval Université, Canada), Anne Sheppard (Royal Holloway, University of London), Salvatore Vasta (University of Catania), Andrea Vella (University of Catania).
[2017]}

They draw particular attention to the intellectual approaches which shaped the interplays among these traditions - interplays that were characterized by the contact of various languages being used by people of different religious beliefs in their quest for knowledge: Spanish Jews writing in Arabic, Jews collaborating in the translation of Arabic texts into Latin through the vernacular, Western Muslims whose writings were read mainly by Jews and Christians in Hebrew and Latin, etc. Altogether, the eleven studies contained in this book wish to offer new insights into the rich exchanges of knowledge among communities of learning and their scholarly traditions during the Middle Ages and beyond.
[2017]}

Phantasia in Aristotle’s Ethics investigates his claim and its reception in ancient and medieval Aristotelian traditions, including Arabic, Greek, Hebrew and Latin.

While contemporary commentators on the Ethics have overlooked Aristotle’s remark, his ancient and medieval interpreters made substantial contributions towards a clarification of the claim’s meaning and relevance. Even when the hazards of transmission have left no explicit comments on this particular passage, as is the case in the Arabic tradition, medieval responders still offer valuable interpretations of phantasia (appearance) and its role in ethical deliberation and action. This volume casts light on these readings, showing how the distant voices from the medieval Arabic, Greek, Hebrew and Latin Aristotelian traditions still contribute to contemporary debate concerning phantasia, motivation and deliberation in Aristotle’s Ethics. These thinkers were from Greek pagan, Muslim, Jewish, and Christian backgrounds and wrote their works in Greek, Arabic, Hebrew, and Latin. Still, they shared similar philosophical views of what constitutes the Highest Good, and of the intellectual activities to be undertaken in pursuit of that Good. Yet, they differed, often greatly, in the role they assigned to deeds and practical activities in the pursuit of this happiness. These differences were, at times, not only along religious lines, but also along political and ethical lines. Other differences treated the relationship between the body and intellectual happiness and the various ways in which bodily health and well-being can contribute to intellectual health and true happiness.
["Happiness, Eros, and the Active Intellect: Understanding Erotic Desire in Averroes’s Long Commentary on Aristotle’s Metaphysics Λ in Light of the Middle Commentary on the Nicomachean Ethics"]}
