The Possibility of Religious Freedom: Early Natural Law and the Abrahamic Faiths, 2019

Religious freedom is one of the most debated and controversial human rights in contemporary public discourse. At once a universally held human right and a flash point in the political sphere, religious freedom has resisted scholarly efforts to define its parameters. Taliaferro explores a different way of examining the tensions between the aims of religion and the needs of political communities, arguing that religious freedom is a uniquely difficult human right to uphold because it rests on two competing conceptions, human and divine. Drawing on classical natural law, Taliaferro expounds a new, practical theory of religious freedom for the modern world. By examining conceptions of law such as Sophocles' Antigone, Maimonides' Guide of the Perplexed, Ibn Rushd's Middle Commentary on Aristotle's Rhetoric, and Tertullian's writings, The Possibility of Religious Freedom explains how expanding our notion of law to incorporate such theories can mediate conflicts of human and divine law and provide a solid foundation for religious liberty in modernity's pluralism.

The endeavour to prove God’s existence through rational argumentation was an integral part of classical Islamic theology (kalām) and philosophy (falsafa), thus the frequently articulated assumption in the academic literature. The Islamic discourse in question is then often compared to the discourse on arguments for God’s existence in the western tradition, not only in terms of its objectives but also in terms of the arguments used: Islamic thinkers, too, put forward arguments that have been labelled as cosmological, teleological, and ontological. This book, however, argues that arguments for God’s existence are absent from the theological and philosophical works of the classical Islamic era. This is not to say that the arguments encountered there are flawed arguments for God’s existence. Rather, it means that the arguments under consideration serve a different purpose than to prove that God exists. Through a close reading of the works of several mutakallimūn and falāsifa from the 3rd‒7th/9th‒13th century, such as al-Bāqillānī and Fakhr al-Dīn al-Rāzī as well as Ibn Sīnā and Ibn Rushd, this book proffers a re-evaluation of the discourse in question, and it suggests what its participants sought to prove if it is not that God exists.

This essay is a brief exploration of the Scriptural exegesis of the most noteworthy sons of Cordoba, Averroes or Ibn Rushd (1126-1198) and Moses Maimonides or Rambam (1135-1204). We will examine the manner of their exegesis of the Scriptural texts, the Qur'an and the Torah, of their respective religious communities. Although Averroes is nine years older than Maimonides, they are near contemporaries. We do not know whether in their youths these Cordobans ever met; they will emerge as two of the most renowned scholars and judges of their communities.

This book intends to introduce readers to the work of Charles E. Butterworth, and thereby to introduce students to Medieval islamic political philosophy, of which Butterworth is one of the world's most prominent scholars. In a wider sense, the Festschrift introduces its readers to the current debates on Medieval islamic political philosophy, related as they are to the questions of the relationship between islam and Christianity, the Medieval to the Modern world, and reason and revelation. Butterworth's scholarship spans six decades, primarily translating, editing, and interpreting the works of the Muslim political philosopher Alfarabi (d. 950) and Averroes (Ibn Rushd, d. 1198). He began his studies of Muslim political philosophy at a time when the Middle East and islam did not have the political salience they have acquired in more recent years. instead, Butterworth&;s reason for engaging with islam was rooted in the question of the relationship between reason and revelation. While one possible answer was pursued in the Christian, latin West, the islamic borderlands of Greek, Roman, and Muslim civilization offered another. By exploring Averroes, who provides the possibility of an Aristotelian-Islamic political philosophy, and Alfarabi, who pursues a Platonic-islamic political philosophy, Butterworth showed how islamic civilization provided a viable alternative to the theologico-political question reason v revelation, as well as serving as an inspiration to the latin West.

The article considers how Averroes makes use of Quranic verses in his works and classifies them into different categories. His theological treatise, that can be translated as Disclosure of the Proof Methods Concerning the Principles of Religion, based on Quranic verses, belongs to the first category. Averroes middle commentary on the Aristotelian Rhetoric belongs to the second, in which the Qur’an is quoted as a literary paradigm. In the third category we find his ‘Definitive Treatise’, written in the form of a fatwā or legal response. His philosophical works belong to the last category, in which Averroes makes use of Quranic verses to buttress his interpretation of Aristotle.

In this treatise Ibn Rushd (Averroes) sets out to show that the Scriptural Law (shar’) of Islam does not altogether prohibit the study of philosophy by Muslims, but, on the contrary, makes it a duty for a certain class of people, those with the capacity for “demonstrative” or scientific reasoning. Apparent conflicts between the teachings of Scripture and philosophy can be reconciled by allegorical interpretations of Scripture, though such interpretations should not be taught to the common people. Ibn Rushd’s contribution to what was clearly a lively debate in Almovarid Andalusia is here accompanied by extracts from two other relevant works, his Damima and Kitab al-Kashf ‘an Manahij al-Adilla, and all are covered by a full introduction and notes.

Al-Ghazālı̄ famously claims in the Incoherence of the Philosophers that al-Fārābī and Avicenna are unbelievers because they hold philosophical positions that conflict with Islam. What is less well-known, however, is that Averroës claims in the Decisive Treatise that al-Fārābī and Avicenna are not unbelievers; rather, al-Ghazālı̄ is the true unbeliever for writing the Incoherence of the Philosophers. In this paper, my aim is to present a sustained reconstruction of Averroës’ legal and philosophical argument for why al-Ghazālı̄ is an unbeliever. The crux of Averroës’ argument is that al-Ghazālı̄ has expressed false allegorical interpretations of scripture to unqualified persons, which has caused them to fall into unbelief. By being causally responsible for other people’s unbelief, al-Ghazālı̄ is an unbeliever as well.
